Terms of Service

These Terms of Service form an agreement between you and McMillan Trade Supply Co. ("McMillan", "we", "us"). By accessing or using our website at this domain, or by placing an order with us by any means, you agree to be bound by these Terms.

The website and our wholesale services are intended for businesses, government entities and adult individuals located in the United States. You represent that you are at least 18 years old and authorized to bind the entity on whose behalf you are placing an order.

All quotes are valid for 30 days unless stated otherwise. Catalog pricing is subject to change without notice. We reserve the right to refuse or cancel any order, including for pricing errors, inventory shortages or suspected fraud. An order is binding once we send a written acknowledgment (email or signed PO acceptance).

Credit-card and ACH orders are charged at the time of shipment. Net-30 accounts are invoiced at shipment with payment due 30 days from the invoice date. Overdue balances accrue interest at 1.5% per month or the maximum allowed by Ohio law, whichever is lower. We may suspend deliveries on accounts with overdue balances.

Risk of loss transfers to the buyer at the time of shipment (FOB origin) for freight orders and at delivery for orders on our local routes. Delivery dates are estimates; we are not liable for delays caused by carriers, weather or other circumstances outside our control. See our Shipping & Delivery page.

Most stocked products may be returned within 30 days of delivery in their original packaging for a full refund or credit. Custom-spec corrugated, opened chemicals and special-order items are non-returnable. Full details on our Returns Policy page.

Products we sell carry whatever warranty their manufacturer provides; McMillan passes those warranties through to the buyer. EXCEPT FOR THOSE PASS-THROUGH WARRANTIES, ALL PRODUCTS AND SERVICES ARE PROVIDED "AS IS" AND WE DISCLAIM ALL OTHER WARRANTIES TO THE FULLEST EXTENT PERMITTED BY LAW, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

To the maximum extent permitted by Ohio law, McMillan's total liability for any claim arising from these Terms or a transaction with us is limited to the amount you paid for the products at issue. We are not liable for indirect, incidental, consequential or punitive damages.

All content on this website — including text, photography, logos and the company name — is owned by or licensed to McMillan Trade Supply Co. You may not copy, reproduce, distribute or create derivative works without our written permission.

You agree not to use the website to: (a) attempt to gain unauthorized access; (b) submit fraudulent orders; (c) interfere with the operation of the site; or (d) violate any applicable law.

These Terms are governed by the laws of the State of Ohio, without regard to its conflict of laws rules. Any dispute will be resolved exclusively in the state or federal courts located in Lucas County, Ohio, and the parties consent to the jurisdiction of those courts.

We may update these Terms occasionally. The "last updated" date reflects the current version. Continued use of the site after a change constitutes acceptance.
